Every company in the Web3 & Decentralized Infra cohort now files against two regimes at once. The EU AI Act sets the substantive duties, the NIS2 directive sets the reporting clock, and a founder who reads only one of them will miss the deadline that actually bites. In the last quarter the median time from an incident to a first notification across this cohort was 19 hours, well inside the 24 hour window, but the spread was wide enough that a quarter of the entities filed late at least once.
The compliance index for the sector stands at 94.2 out of 100, which places it in the low risk band. That number is built from four inputs: the share of entities with a named compliance officer, the share with a documented incident response runbook, the share whose model or product documentation passes an external audit, and the observed notification latency. The first two inputs are close to saturation. The audit input is where the sector still loses points.
What the filings show
Capital is concentrating. The top decile of the cohort raised more in the last quarter than the remaining nine deciles combined, and the gap widened rather than closed after the summer. That pattern is familiar from earlier cycles, but the mechanism is different this time: the concentration follows procurement, not sentiment. Entities holding a public sector or defence contract raised at a median pre-money roughly 40 percent above their peers with comparable revenue.
Patent activity tells the quieter half of the story. Filings are up across the cohort, yet grant rates have slipped, which usually signals crowding in the claim space rather than a drop in quality. For an investor reading this dossier the practical test is simple: ask whether the claims cover a process the company actually runs, or a process it hopes to run once the round closes.
What to watch next quarter
Three things. First, whether the notification latency holds as headcount grows, since the late filings clustered in companies that doubled staff in a single quarter. Second, whether the audit input moves, because it is the only component of the compliance index with real room left. Third, whether procurement driven valuations survive the next budget cycle, which is the part of this sector no model can price.
